Gilman Law LLP is investigating potential employee misclassification claims against D.R. Horton, a major U.S. home builder, for possible violations of various state and federal labor laws. Horton, we would like to hear from you regarding minimum wage violations, denial of overtime pay and other possible violations of the federal Fair Labor Standards Act (FLSA).
Federal Investigation of D.R. Horton Wage Practices
D.R. Horton and several other large home builders have been targeted by a U.S. Department of Labor (DOL) investigation into possible wage violations. In August, the Labor Department sent letters to large home builders, including D.R. Horton, seeking information about their pay practices. The DOL is also investigating allegations that many home builders misclassify employees as independent contractors to circumvent federal wage laws. Independent contractors also aren’t covered by minimum wage and overtime laws, or unemployment and workers’ compensation insurance.
The Internal Revenue Service (IRS) is also sharing information with the DOL as part of the home builder wage investigation. The IRS is interested because employers don’t withhold income taxes or pay Social Security or Medicare taxes for employees classified as independent contractors. As a result, misclassification of employees as independent contractors could be costing U.S. taxpayers billions of dollars every year.
D.R. Horton, which claims to be the largest home builder in the U.S. by number of homes built, has operations in 71 markets in 26 states. The Company is engaged in the construction and sale of homes with sales prices ranging from $90,000 to over $700,000. D.R. Horton also provides mortgage financing and title services for homebuyers through its mortgage and title subsidiaries.
