Federal Investigation of KB Home Wage Practices and Employment Misclassification

KB Home and several other large home builders have been targeted by a U.S. Department of Labor (DOL) investigation into possible wage violations. The company was among a number of home builders that received a letter from the DOL inquiring about pay practices, after several smaller probes turned up minimum wages violations, denial of overtime pay, and other violations of wage laws by some firms. The DOL is also investigating allegations that many home builders misclassify employees as independent contractors to circumvent federal wage laws. Independent contractors aren’t covered by minimum wage and overtime laws, or unemployment and workers’ compensation insurance.

Misclassification of employees as independent contractors could be costing U.S. taxpayers billions of dollars every year, as employers don’t withhold income taxes or pay Social Security or Medicare taxes for independent contractors. Because of this, the Internal Revenue Service (IRS) is also sharing information with the DOL as part of the home builder wage investigation.
