Federal Investigation of Lennar Corp. Wage Practices
Lennar Corp. and several other large home builders have been targeted by a U.S. Department of Labor (DOL) investigation into possible wage violations. In August, the Labor Department sent letters to large home builders, including Lennar Corp., seeking information about their pay practices. The DOL decided to launch the industry-wide probe after recent individual investigations turned up violations of labor laws by some firms, including minimum wages violations, and denial of overtime pay and benefits. The DOL is also investigating allegations that many home builders misclassify employees as independent contractors to circumvent federal wage laws. Independent contractors aren’t covered by minimum wage and overtime laws, or unemployment and workers’ compensation insurance.
The DOL has been joined in its investigation by the Internal Revenue Service (IRS). The IRS is interested in Lennar Corp.’s wage practices because employers don’t withhold income taxes or pay Social Security or Medicare taxes for employees classified as independent contractors. A Government Accountability Office report from 2009 found that the misclassification of workers cost the federal government $2.72 billion in 2006.
Lennar Corp., based in Miami, Florida, constructs and sells single-family attached and detached homes and multi-level buildings. The Company is also engaged in the purchase and sale of residential land, and provides mortgage financing, title insurance, closing services and other ancillary services.
