About the Fair Labor Standards Act and State Labor Laws
The Fair Labor Standards Act (“FLSA”) requires companies to pay all non-exempt employees one and one-half times the regular rate of pay for all hours worked over forty (40) per workweek. Verizon Wireless, however, has allegedly forced its call center employees to perform work-related tasks without being compensated for the hours spent performing these tasks. An example of some tasks that can trigger overtime claims or claims for unpaid wages under the FLSA are listed below:
- Time Spent Booting-up and Shutting Down Computers
- Preparing or Review Reports Before Shifts
- Initializing or Closing Down Software Programs
- Review or Responding to E-mail Messages
- Participating in Conference Calls
- Responding to Intranet or Inter-office Messages
